GENERAL TERMS OF USE OF THE KROQI PLATFORM
Version of October 16, 2024
As part of the Digital Transition Plan for the Building Industry (PTNB), and then the BIM 2022 Plan, the French government tasked CSTB with developing a digital services platform (hereinafter referred to as the “KROQI Platform”) aimed at facilitating the digital transition of construction sector stakeholders, particularly very small and medium-sized businesses. CSTB was the operator of this platform until August 2024. Since September 2024, KROQI SAS has been its operator, and CLOUD SOLUTIONS SAS, among others, commercializes the solution.
ARTICLE 1: PRELIMINARY ARTICLE, DEFINITIONS
1.1. KROQI Platform
Refers to the digital services platform put in place by the public authorities and accessible online via the / domain. The KROQI Platform is intended only for construction professionals. Use of the KROQI Platform is only possible over the web network. The KROQI Platform is composed of:
- A Collaborative Suite
- A Service Orchestrator
- Core Services.
Use of the KROQI Platform is free of charge as long as:
- an Initial User, administrator of a Workspace:
- invites fewer than 3 Standard Users
- the size of the Initial User’s Workspace is less than or equal:
- to 5 GB
- the number of projects is less than or equal:
- to 5 Projects
- an Initial User, administrator of a Workspace, does not wish to benefit from a broader functional scope than that of the free offering.
When one of these four conditions is not met, use of the KROQI Platform becomes paid. The terms of the paid offers are accessible on this page: /prix/.
1.2. Collaborative Suite
Refers to the WIMI Collaborative Suite, published by Cloud Solutions and integrated into the KROQI Platform. This Collaborative Suite first provides a Document Management System (DMS) that supplies the KROQI Platform with:
- The user interface;
- The hosting of Project Data and its sharing between Users of the Workspace;
- Access rights management within the Workspace.
The Collaborative Suite offers other collaborative work services such as:
- An instant messaging service;
- A video conferencing tool (Airtime);
- A shared electronic calendar;
- A task management tool;
- An integrated email reader;
- An electronic signature tool;
- An approval generator.
1.3. Service Orchestrator
Refers to the set of technical components of the KROQI Platform that allow Data to transit between the Collaborative Suite and Third-Party Services or Core Services, through an application programming interface (API).
1.4. Third-Party Services
Refers to online services and/or software that are complementary to and interconnected with the KROQI Platform, developed using their own funds by Third-Party Publishers and managed by them.
The use of Third-Party Services is optional and may involve fees.
The Initial User who wishes to subscribe to a license for a paid Third-Party Service must also subscribe to a paid license for the KROQI Platform.
The use of certain Third-Party Services may require the user to log in to an authentication system specific to that Third-Party Service.
In other cases, the Single Sign-On of the KROQI Platform allows the User to access the Third-Party Service.
1.5. Third-Party Publisher
Refers to any publisher of a Third-Party Service.
1.6. Knowledge Base
Refers to the website accessible via https://kb.kroqi.fr/base-de-connaissance-kroqi, which allows KROQI SAS to present tutorials (videos and text) aimed at facilitating use of the KROQI Platform. These tutorials are accessible to any internet user.
1.7. Initial User
Refers to the construction professional (designating the natural person acting in their own name or the legal entity represented by a natural person) who has entered their Personal Data (last name, first name, email) on the KROQI Platform’s Single Sign-On and who then creates a Workspace on the KROQI Platform.
The Initial User can then access their Workspace on the KROQI Platform after authenticating through the KROQI Platform’s Single Sign-On using their password and identifier.
Prior to their first connection to the KROQI Platform, the Initial User must have read and accepted these General Terms of Use of the KROQI Platform.
The Initial User has the option of inviting Standard Users to access their Workspace. Depending on the number of Standard Users, use of the KROQI Platform may be free or paid (see article 1.1.).
Furthermore, an Initial User may contact KROQI to transfer their rights to a Standard User.
1.10. Standard User
Refers to the construction professional (designating the natural person acting in their own name, or the legal entity represented by a natural person) who has been invited by the Initial User, or by a Standard User holding the necessary rights, to access all or part of the Initial User’s Workspace on the KROQI Platform.
To invite a Standard User, the Initial User enters the Standard User’s Personal Data (last name, first name, and email) into the KROQI Platform Workspace, which triggers an email to the Standard User containing a temporary password and identifier (the email address entered by the Initial User) enabling them to log in to the KROQI Platform’s Single Sign-On.
Prior to their first connection to the KROQI Platform, the Standard User must read and accept these General Terms of Use of the KROQI Platform as well as those of WIMI.
Provided the Initial User has granted them the right, the Standard User can in turn invite other Standard Users to access the Initial User’s Workspace. To do so, the Standard User enters the new Standard User’s Personal Data (last name, first name, email), which triggers an email to the Standard User containing a temporary password and identifier enabling them to log in to the KROQI Platform’s Single Sign-On.
1.11. Users
Refers to Initial Users and/or Standard Users.
1.12. KROQI Platform Single Sign-On
Refers to the authentication mechanism allowing Users to access the Workspaces they have created or to which they have been invited, to use the Core Services and certain Third-Party Services (which do not have their own authentication mechanism), from any terminal with internet access, after entering their identifier and password. The User’s identifier is the one provided by KROQI when KROQI notifies the User of the creation of their account in accordance with the provisions of Article 5. The Personal Data entered into the KROQI Platform’s Single Sign-On is then used by Cloud Solutions to operate the Collaborative Suite.
In accordance with the historical contract concluded by CSTB with the company Worteks, and taken over by CLOUD SOLUTIONS SAS, Worteks is responsible for the integration, hosting, maintenance, and support of the KROQI Platform’s Single Sign-On. Under this contract, CSTB subcontracted to Worteks the collection and processing of Users’ Personal Data, in accordance with the provisions of Article 28 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016.
1.13. Third-Party Service Authentication Mechanism
Some Third-Party Services have their own authentication mechanism, allowing the User to access the Third-Party Service they have chosen from any terminal with internet access, after entering the identifier sent by the Third-Party Publisher and their password. This authentication mechanism is managed by the relevant Third-Party Publisher.
1.14. Project Data
Refers to information relating to a Project entered by a User in their Workspace, whatever the nature of this information, provided it relates to the construction field (numeric and alphanumeric characters, graphic indicators, and/or computer files, etc.), whether or not it is protectable under intellectual property law, with the exception of Personal Data.
Project Data also refers to:
- modifications made by the User to the Project Data they have entered;
- as well as modifications a User makes to Project Data entered by other Users working on the same Project.
Project Data may be consulted, used, and/or modified by other Users working as part of the same Project depending on the scope of their rights.
However, it is not accessible to Users of another Workspace.
1.15. Personal Data
Refers to all information relating to the User of the KROQI Platform, an identified or identifiable natural person, such as their last name, first name, and email, entered by the User into the KROQI Platform’s Single Sign-On.
1.16. Data
Refers to the User’s Personal Data and Project Data.
All of this Data is necessary:
- for the Core Services to enable KROQI to identify the User of the Core Services and to send them notifications;
- for Third-Party Services to enable each Third-Party Publisher to identify the User of the Third-Party Service and to send them notifications.
Furthermore, the User authorizes KROQI SAS to communicate Personal Data to Cloud Solutions for the proper operation of the Collaborative Suite.
1.17. Results
Refers to the results, whatever their form and nature, obtained by Users through their use of the KROQI Platform.
1.18. Workspace
Refers to a Workspace on the Collaborative Suite, created by an Initial User, within which Users working on shared projects can enter/export their Project Data, view it, modify it, and possibly modify Project Data entered by other Users working on the same Project.
Workspaces are entirely independent of one another.
A Workspace enables the management of multiple Projects and access to the Data of those Projects. Every Workspace must have a unique name on the KROQI Platform, which will lead to the creation of a unique URL of the form https://[workspace name].kroqi.fr/ for that Workspace on the KROQI Platform.
Project Data entered in a Workspace is stored on the Collaborative Suite.
The maximum volume of the Workspace varies depending on whether the Initial User is under the conditions of free use of the KROQI Platform or under paid use of the KROQI Platform (see article 1.1.).
1.19. Project
Refers to a subdivision of a Workspace to which a User may invite one or more Users depending on the scope of their rights.
Each User with access to a Project in a Workspace may enter their Project Data there. This Project Data is stored on the Collaborative Suite and accessible to other Users depending on the scope of their rights.
1.20. Error
Refers to:
- Any difficulty in connecting to the KROQI Platform’s Single Sign-On
- Any incident, anomaly, bug, defect, or other malfunction of KROQI.
ARTICLE 2: Purpose
The purpose of these General Terms of Use of the KROQI Platform is to define the conditions of access to the KROQI Platform as well as those of its use by Users.
KROQI SAS reserves the right to unilaterally modify the content of these General Terms of Use at any time.
